Use of Our Website

SparkFilter provides digital marketing services including, but not limited to: SEO, AEO/GEO strategy, PPC and paid advertising management, WordPress website design and development, social media management, cloud infrastructure and Cloudflare/AWS management, and WordPress maintenance and technical support.
Specific service scope, deliverables, timelines, and fees for any engagement are agreed separately in a proposal, quote, or service agreement between SparkFilter and the client. These Terms apply in addition to, and do not replace, any signed service agreement.
No Guaranteed Results
While SparkFilter uses industry best practices to improve search rankings, AI citation visibility, advertising performance, and website quality, we do not guarantee specific rankings, traffic levels, lead volumes, or revenue outcomes. Search engines, AI platforms (such as Google, ChatGPT, and Perplexity), and advertising platforms (such as Google Ads and Meta) control their own algorithms and policies, which are outside our control and subject to change at any time.
Client Responsibilities
To deliver services effectively, clients agree to:
- Provide timely access to necessary accounts, credentials, content, and information
- Review and approve deliverables (such as website designs, ad campaigns, or content) within a reasonable timeframe
- Ensure that any content, images, or materials provided to us for use in campaigns or on websites do not infringe on third-party rights
- Make payments according to the agreed schedule in the applicable service agreement or invoice
Fees and Payment
Fees for services are outlined in the applicable proposal, quote, or invoice provided to the client. SparkFilter does not require long-term lock-in contracts for most services; specific cancellation and refund terms, if any, will be stated in the individual service agreement. Late or non-payment may result in suspension of services.
Intellectual Property
All content on this Site — including text, graphics, logos, and design elements — is the property of SparkFilter or its licensors and is protected by applicable intellectual property laws, unless otherwise stated. You may not reproduce, distribute, or create derivative works from our Site content without prior written consent.
For client projects (e.g., websites, ad creatives, content), ownership of final deliverables transfers to the client upon full payment, unless otherwise specified in the applicable service agreement. SparkFilter retains the right to showcase completed work in its portfolio and marketing materials unless the client requests otherwise in writing.
Third-Party Services and Platforms
Our services may involve the use of third-party platforms such as Google Ads, Google Analytics, Meta (Facebook/Instagram), Cloudflare, AWS, and WordPress plugins or themes. Your use of these platforms, once connected through our services, is also subject to their respective terms of service and policies, over which we have no control.
Limitation of Liability
To the fullest extent permitted by law, SparkFilter shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or our services, including but not limited to loss of profits, data, traffic, or business opportunities, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from our services shall not exceed the total fees paid by the client for the specific service giving rise to the claim.
Indemnification
You agree to indemnify and hold SparkFilter harmless from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms, misuse of our services, or infringement of any third-party rights through content or materials you provide to us.
Termination
We reserve the right to suspend or terminate your access to the Site, or discontinue services, at our discretion if these Terms are violated. Either party may terminate an ongoing service engagement according to the notice terms specified in the applicable service agreement.
Governing Law
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or our services shall be resolved through good-faith negotiation in the first instance.
Changes to These Terms
We may update these Terms of Service from time to time to reflect changes in our services, legal requirements, or business practices.
